Mr. Michaud focuses his practice on Fair Credit Reporting, Fair Debt Collection Practices and Unfair Trade Practices litigation. In this capacity, Mr. Michaud currently serves as lead counsel in several ongoing consumer protection cases involving national banks, mortgage servicers and credit reporting agencies, and has previously served in the same capacity in several successfully resolved cases.
Mr. Michaud secured reversal and remand from the United States Court of Appeals for the Fifth Circuit in a case involving dual-tracking, robo-signing and notably, the effectiveness of a liability shield between limited liability companies and series limited liability companies created within the structure of the parent LLC in Alphonse v. Arch Bay Holdings, LLC, No. 13-30154, 2013 WL 6490229 (5th Cir. Dec. 11, 2013).
Prior to forming Michaud Consumer Law, Mr. Michaud was a partner at Sandler Michaud, LLC and Patrick Miller, LLC. Before that, he maintained his own firm for many years. In this role, Mr. Michaud represented numerous clients subjected to wrongful foreclosure, unfair debt collection, identity theft and those struggling with credit-reporting agencies. Additionally, Mr. Michaud served as lead counsel, representing defrauded investors in a worldwide Ponzi Scheme.
Mr. Michaud graduated law school, cum laude, in 2001 from Suffolk University Law School in Boston, Massachusetts. While in law school, Mr. Michaud served as Note Editor on the Suffolk University Law Review, and published Guilty But Not Responsible: The Need For A Criminal Duty To Mitigate Injuries, 34 Suffolk U. L. Rev. 629 (2001). Thereafter, Mr. Michaud was an associate with prestigious New Orleans corporate defense firms, focusing on lender liability, regulatory compliance, unfair debt collection and general commercial litigation.
In addition to his consumer protection litigation practice, Mr. Michaud defends consumers in foreclosure actions, suits on open account and secured transactions, and in various administrative and regulatory hearings. In this context, Mr. Michaud acts as a defacto arbitrator to resolve disputes.
Mr. Michaud is licensed to practice in all Louisiana state and federal courts.
